Terms of Service

1. Acceptance of Terms

By accessing or using the Prodigio hiring platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users of the Platform, including individuals applying for jobs ("Candidates") and employees or administrators of companies using Prodigio to manage hiring ("Hiring Organisations").

2. Description of Service

Prodigio provides a hiring platform that enables organisations to create branded careers pages, post jobs, receive and manage candidate applications, administer assessments, schedule interviews, generate offer letters, collect digital signatures on employment documents and NDAs, and manage employee onboarding. The Platform is available via subscription and includes AI-assisted features across the hiring pipeline.

3. Eligibility

You must be at least 18 years of age to use this Platform. By using the Platform, you confirm that you meet this requirement, that you have the legal capacity to enter into a binding agreement, and that all information you provide is accurate, current, and complete.

4. Account Registration and Security

Hiring Organisations must create an account to access the dashboard and hiring tools. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@prodigio.io if you suspect unauthorised access to your account.

Candidates access the Platform through unique links provided by the hiring organisation and do not require a persistent account. You are responsible for keeping your application link private.

5. Hiring Organisation Responsibilities

As a Hiring Organisation, you agree to:

• Use the Platform only for lawful hiring and recruitment purposes
• Ensure that job postings are accurate and do not contain discriminatory, misleading, or unlawful content
• Comply with all applicable employment, data protection, and equal opportunity laws in the jurisdictions where you recruit
• Treat candidate data with care and use it only for the recruitment process for which it was submitted
• Not share candidate data with third parties outside your organisation without the candidate's consent or a lawful basis
• Ensure team members who access the Platform are authorised to do so and understand their responsibilities under these Terms
• Not use AI-generated outputs from the Platform as the sole or final basis for any hiring decision without human review

6. Candidate Responsibilities

As a Candidate, you agree to:

• Provide truthful and accurate information in all applications, forms, and assessments
• Not misrepresent your identity, qualifications, experience, or any other material information
• Not attempt to manipulate, circumvent, or gain an unfair advantage in any assessment or evaluation
• Not use unauthorised assistance (including AI generation tools, third parties, or pre-disclosed answers) during assessments
• Respect the confidentiality of assessment content and not share questions, tasks, or answers with others
• Not upload files containing malicious code, spam, or unlawful content

7. Assessment Integrity

The Platform administers assessments to evaluate candidates. These include language proficiency, cognitive ability, and written tasks. During assessments, the Platform monitors certain browser activity to support integrity, such as tab switching and loss of window focus. Video and audio may be recorded during AI-assisted interview sessions where you have been informed in advance.

Any attempt to circumvent integrity measures, use external assistance without authorisation, or complete an assessment on behalf of another person may result in immediate disqualification. The hiring organisation will be notified and may take this into account in their assessment of your application.

8. Prohibited Conduct

All users are prohibited from:

• Attempting to gain unauthorised access to any part of the Platform, its infrastructure, or another user's account
• Reverse engineering, decompiling, or attempting to extract source code from the Platform
• Using automated tools, bots, scrapers, or scripts to access or interact with the Platform without permission
• Uploading malicious software, viruses, or any content designed to damage or disrupt the Platform
• Using the Platform to send unsolicited communications or spam
• Impersonating another person or organisation, or misrepresenting your affiliation with any entity
• Using the Platform in any way that violates applicable law or the rights of any third party

9. Subscription Plans and Billing

Prodigio offers the following plans for Hiring Organisations:

• Starter: Free plan with core hiring features and a monthly AI credit allocation. No credit card required.
• Growth: Paid monthly subscription with expanded AI credits and support for unlimited active jobs.
• Scale: Paid monthly subscription for high-volume hiring with a larger credit allocation.

Paid subscriptions are billed monthly in advance. You may cancel at any time through your billing dashboard; cancellation takes effect at the end of the current billing period and you retain access until then. We do not offer refunds for unused periods of a paid subscription.

Prodigio reserves the right to modify pricing with reasonable prior notice. Continued use of the Platform after a pricing change constitutes acceptance of the new pricing.

10. AI Credits

AI credits power the AI-assisted features available on the Platform, including CV screening, assessment scoring, smart shortlisting, AI interview sessions, and job description generation. Credits are allocated per billing period and do not carry over to the next period.

Additional credit bundles may be purchased at any time from your billing dashboard without changing your plan. Core platform features (including pipeline management, offer letter generation, and digital signing) remain available regardless of your credit balance.

11. Intellectual Property

All content, features, and functionality on the Platform (including text, graphics, logos, assessment content, and underlying software) are the property of Prodigio or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our express written permission.

Content you upload to the Platform (such as CVs, job descriptions, and company branding) remains your property. By uploading it, you grant Prodigio a limited licence to store, process, and display it as necessary to deliver the Platform services.

12. Confidentiality

Assessment content, scoring criteria, and evaluation outputs are confidential to Prodigio and the relevant Hiring Organisation. Candidates must not share, reproduce, or distribute assessment questions or any proprietary content encountered through the Platform. Hiring Organisations must keep candidate evaluation outputs confidential and use them only for the hiring process for which they were generated.

13. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, and protect personal data.

14. Termination and Suspension

We reserve the right to suspend or terminate access to the Platform at any time if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, or if required by law. We will endeavour to provide notice where practicable, except where immediate action is necessary.

Hiring Organisations may close their account at any time through the Platform settings. Upon closure, your account data will be handled in accordance with our Privacy Policy and applicable law.

15. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. Prodigio makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. AI-assisted features are provided to support, not replace, human judgement, and their outputs are not guaranteed to be accurate or complete.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Prodigio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to Prodigio in the three months preceding the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless Prodigio and its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform in violation of these Terms, your breach of any applicable law, or any content you upload or transmit through the Platform.

18. Modifications

Prodigio reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Where changes are material, we will take reasonable steps to notify you. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

19. Governing Law

These Terms are governed by applicable law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the applicable territory. Nothing in these Terms limits your rights under mandatory consumer or data protection laws in your country of residence.
